All cosmetics placed on the market in EU must be notified before being marketed. This is required by Article 13 of the EU Cosmetics Regulation (Regulation (EC) No 1223/2009).

How Does Notification Work?

The following data should be prepared in advance for entry into the Cosmetic Products Notification Portal (CPNP):

  • The product category and name, enabling specific identification
  • Name and address of the Responsible Person who holds the Product Information File (PIF) for the cosmetic product
  • Country of origin if the product is imported
  • Member State where the product will be placed on the market
  • Contact details for a person to be reached if needed
  • Any nanomaterials used (with IUPAC name and conditions of exposure)
  • Names and CAS or EC numbers of any CMR substances
  • Framework formulation / detailed formulation
  • Original label and a photo of the relevant packaging

A special case applies to cosmetics containing nanomaterials: there is an obligation to notify these six months prior to placing the product on the market. Only cosmetics with nanomaterials that are used as colorants, UV filters, or preservatives and that have already been approved under the relevant annexes of the Cosmetics Regulation are exempt from this extended notification requirement. The aim of this measure by the European Commission is to ensure a high level of consumer health protection.
